These Fair Coverage Booking Terms apply to photography and motion services booked through Moongate Studio, operated by Hobbes Media LLC. By submitting a booking and accepting these terms, the client confirms that they are authorized to book services on behalf of the named gallery or organization.
The services included in a booking are determined by the selected coverage package and any written additions confirmed by Moongate Studio.
Coverage is subject to the fair’s schedule, venue access, photography policies, available shooting time, and reasonable cooperation from the client. Specific images, artworks, people, or moments may be requested, but cannot be guaranteed unless confirmed in writing.
Pricing displayed during checkout applies to the selected fair and coverage package. The client may choose to:
• Pay the full booking total at checkout; or
• Pay the stated deposit at checkout and pay the remaining balance separately.
A booking is not confirmed until the required initial payment has been successfully processed.
Payments are securely processed through Stripe. Moongate Studio does not directly store the client’s complete payment-card information.
Deposits are nonrefundable except where Moongate Studio cancels the services and cannot provide a reasonable replacement.
When a deposit is selected, an invoice for the remaining balance will be sent to the client. The balance may be paid at any time and must be paid no later than 14 days before the fair begins, unless another deadline is confirmed in writing.
Failure to pay the remaining balance by the stated deadline may result in cancellation of the booking and release of the reserved coverage time.
When a booking is submitted within 14 days of the fair’s start date, payment in full is required at checkout and the deposit option will not be available.
If the client cancels 30 or more calendar days before the fair begins, Moongate Studio may refund payments received above the nonrefundable deposit.
If the client cancels fewer than 30 calendar days before the fair begins, all amounts paid are nonrefundable.
Moongate Studio may, at its sole discretion, approve a refund, credit, or transfer when the client provides sufficient documentation of illness, significant travel disruption, fair cancellation, or another extraordinary circumstance. Granting an exception in one instance does not waive or modify this policy for any other booking.
If Moongate Studio cancels the services and cannot provide a reasonable replacement, all payments made for the affected services will be refunded.
Fair dates, schedules, venues, access rules, and exhibitor arrangements are controlled by the fair organizer and may change after booking.
If a fair is postponed or rescheduled, Moongate Studio will make reasonable efforts to transfer the booking to the new dates. Availability cannot be guaranteed. Any refund, credit, or transfer will be determined according to the circumstances and the cancellation policy above.
The client is responsible for:
• Providing accurate booking and contact information
• Confirming booth details, schedules, and access requirements
• Securing any permissions required to photograph artworks, installations, staff, guests, or restricted areas
• Identifying priority artworks, people, or moments before coverage begins
• Maintaining a safe and accessible working environment
Delays, access limitations, missing permissions, or inaccurate information may reduce the coverage that can reasonably be completed.
Moongate Studio retains creative discretion over image selection, composition, editing, color treatment, and final delivery.
Delivery timing is based on the fair schedule and selected package. Any delivery estimate shown on the fair portal is an estimate and may change because of the volume or complexity of the engagement.
Unedited files, RAW files, project files, and unused footage are not included unless specifically agreed to in writing.
Once all required payments have been received, the client receives a nonexclusive license to use the delivered work for the gallery’s website, social media, email, press outreach, editorial communication, exhibition promotion, collector communication, and other ordinary gallery marketing purposes.
The client may not sell, sublicense, substantially alter, or provide the work to an unrelated third party for commercial use without written permission.
Copyright remains with Hobbes Media LLC unless a separate written copyright transfer is executed.
Moongate Studio may use delivered work for its website, portfolio, social media, publications, awards, and self-promotion unless the client and Moongate Studio agree otherwise in writing.
Photography by Moongate Studio does not transfer or clear copyrights, trademarks, publicity rights, or other rights belonging to artists, estates, galleries, subjects, venues, or fair organizers.
The client is responsible for obtaining any permissions needed for its intended publication or commercial use of the delivered work.
To the fullest extent permitted by law, the total liability of Hobbes Media LLC arising from a booking will not exceed the amount the client paid for the affected services.
Hobbes Media LLC is not responsible for indirect, incidental, special, or consequential losses, including lost sales, lost opportunities, or loss of anticipated publicity.
Nothing in these terms excludes liability that cannot legally be excluded.
Moongate Studio is not responsible for delay or inability to perform caused by circumstances beyond its reasonable control, including severe weather, illness, transportation interruption, venue closure, government action, labor disruption, equipment loss despite reasonable precautions, or cancellation or restriction imposed by a fair organizer.
Moongate Studio will make reasonable efforts to communicate promptly and provide an appropriate replacement, credit, rescheduling option, or refund where practical.
These terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.
These terms, the selected booking details, and any written additions confirmed by Moongate Studio constitute the agreement between the parties regarding the booked services.
Any amendment must be confirmed in writing. If one provision is found unenforceable, the remaining provisions will continue in effect.
